Terms of Service

These Terms are an agreement between you and Engage Element LLC, a New York limited liability company operating the GoChinaCare service ("GoChinaCare," "we," "us"). By using www.gochinacare.com or engaging our services, you agree to these Terms and to our Privacy Policy and Medical Disclaimer.

1. What GoChinaCare is — and is not

GoChinaCare is a care-coordination and travel-facilitation service. We help you assemble your medical records, obtain review by hospitals and physicians in China, receive treatment plans and itemized quotes, and — if you decide to proceed — arrange visas, travel, interpretation, and on-ground support.

We are not a healthcare provider. We do not practice medicine, provide medical advice, diagnose, or treat. All medical services are provided by independent hospitals, clinics, and physicians who are not our employees or agents and over whose clinical judgment we have no control. No physician-patient relationship is created between you and GoChinaCare. Do not use our service for medical emergencies — call 911 (U.S.) or your local emergency number.

2. Eligibility

You must be at least 18 and able to enter a binding contract. If you are arranging care for someone else, you confirm you are authorized to share their information and act on their behalf.

3. Services, quotes, and packages

Our current packages are described on our Services and Pricing pages, including Remote Second Opinion ($399), Journey Planning ($299, credited toward your trip if you travel with us), and Full Coordination (custom quote). Itemized treatment quotes we obtain for you are prepared by the treating hospital and are valid for the period stated on the quote (typically 30 days). All prices shown on our website are illustrative estimates pending your itemized quote. Savings comparisons reference typical U.S. list prices and your actual savings will vary.

4. Independent providers

Hospitals, physicians, labs, insurers, airlines, hotels, and ground-service vendors are independent third parties. We select and vet coordination partners with care, but we are not responsible for the clinical outcomes, acts, or omissions of independent medical providers, or for delays and failures caused by airlines, hotels, visa authorities, or other third parties. Your treatment contract is between you and the treating hospital; hospital and clinical fees are paid by you directly to the hospital.

5. Your responsibilities

You agree to provide accurate, complete information and genuine medical records; to consult your own physician at home before making treatment decisions and about fitness to travel; to obtain valid travel documents and comply with visa conditions; to follow the treating physicians' instructions; and to consider travel-medical insurance, including medical-evacuation coverage, which we strongly recommend. You acknowledge that receiving care abroad involves a different legal and regulatory system, and that legal recourse for medical care received in China may differ from what is available in your home country.

6. Fees, payment, and refunds

Our coordination fees are flat fees, disclosed before you commit, and are not a percentage of your treatment cost. We do not accept per-patient referral commissions from hospitals. Payments are processed by third-party payment processors; taxes are your responsibility where applicable.

Cancellations and refunds: if you cancel before hospital matching begins, your coordination fee is refunded in full. After your treatment plan and quote have been delivered, the planning fee is retained. For trips in progress, unused third-party services (hotels, ground transport) are refunded to the extent the vendor refunds us. Where a visa is refused despite our documentation support, we refund our visa-support fee. The operative refund terms for your engagement are those stated in your service agreement and on our Pricing page at the time of purchase.

7. Communications

By submitting a case review or contacting us, you agree that we may respond by email, phone, or messaging apps you use to reach us (such as WhatsApp). You can opt out of non-essential communications at any time. Our "reply within 24 hours" commitment is a service goal we take seriously, not a contractual guarantee.

8. Patient portal

Portal access uses one-time login links sent to your email. Keep your email account secure; you are responsible for activity under your login. We may suspend access to protect you or the service.

9. Acceptable use and site content

Do not misuse the site (no scraping for republication, no security probing, no unlawful use). Site content is owned by us or our licensors and is provided for your personal use. 10. Services we do not arrange

We do not arrange organ transplantation, assisted reproduction, prenatal sex determination, or therapies outside legally approved channels in the treating jurisdiction.

11. Disclaimers

Except as expressly stated, the service and site are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant any medical outcome, treatment availability, timeline, or level of savings.

12. Limitation of liability

To the fullest extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits; our total aggregate liability for claims arising out of the service is limited to the greater of (a) the coordination fees you paid us in the 12 months before the event giving rise to the claim, or (b) US $500. Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct, or fraud. Claims relating to medical care itself lie against the treating provider, not GoChinaCare.

13. Indemnification

You will indemnify us against third-party claims arising from your breach of these Terms, your violation of law, or materially inaccurate information you provided, except to the extent caused by our own negligence or misconduct.

14. Dispute resolution — please read

Informal first. Email hello@gochinacare.com with "Dispute" in the subject; we will work with you in good faith for 60 days.

Arbitration. Any dispute not resolved informally will be finally resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat is New York, New York; hearings may be conducted remotely; AAA consumer fee rules apply. Either party may instead bring an individual claim in small-claims court.

Class waiver. Disputes are resolved on an individual basis only; you and we each waive any right to class or representative proceedings, to the extent permitted by law.

Opt-out. You may opt out of this arbitration section by emailing us within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.

15. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. For matters not subject to arbitration, the state and federal courts located in New York County, New York have exclusive jurisdiction.

16. Changes, termination, and the rest

We may update these Terms by posting a new version with a new date; material changes will be notified to active clients. Either party may end an engagement per the refund terms in Section 6. If any provision is unenforceable, the rest remain in effect. These Terms plus your service agreement are the entire agreement; you may not assign them without our consent.
